WA Small Business Benchmarks (WASBB) Limitation of Liability (user acceptance required)

Curtin University of Technology (and its contractors) through Curtin Business School (herein referred to as “Curtin”) confirms that personal details which a participant provides Curtin for the purposes of the Benchmarks Survey will:

(1)  be kept strictly confidential and shall not be disclosed to a third party without the written authorisation of the owner entrant of that confidential information; and

(2)  comply with Curtin’s privacy policy and protocols.

Curtin University of Technology has used reasonable care and skill in compiling the content of this survey and methodology. However, Curtin, its employees, sponsors and contractors make no warranty as to the accuracy or completeness of any information in the data gathered.

Curtin makes no warranty, representation or undertaking whether expressed or implied, nor does it assume any legal liability, whether direct or indirect, or responsibility for the accuracy, completeness, or usefulness of any information received, reproduced or provided or otherwise as part of the Benchmark Survey.

Curtin accepts no liability whether direct or indirect for any loss or damage a WASBB participant may incur arising out of or as a result of directly or indirectly relying on any information of the Benchmark Survey.

Curtin makes no warranty, representation or undertaking whether expressed or implied, nor does it assume any legal liability, whether direct or indirect, or responsibility for any decisions, expectations or anticipation of benefits that a Benchmark Survey participant or recipient may make,  hold or act upon as a result of or arising out of the Benchmark Survey.

Curtin makes no warranty, representation or undertaking whether expressed or implied, nor does it assume any legal liability, whether direct or indirect, or responsibility for the use, whether general or specific use of the Benchmark Survey or that the Benchmark Survey will meet all or any requirements of the participant, including but not limited to the participant's business requirements or business expectations.

Curtin accepts no liability whether direct or indirect for any loss or damage a Benchmark Survey participant may incur in respect of the direct or indirect use or reliance on any information of the Benchmark Survey.

Curtin specifically excludes and shall not be responsible for any for any and all special, indirect or consequential loss or damages (including but not limited to economic loss).
